Claims and authorization

Gold Shield Services, LLC, doing business as Goldshield Home Warranty (the Company), must be called for all claims before repairing. The Company will not reimburse for services performed without its authorization or for claims called in after contract expiration. Homeowners may be requested by the Company to find and coordinate service for covered items.

Termination, transfer, and monthly payments

This Service Contract will automatically terminate for non-payment of Service Contract fees or deductibles, or for fraud and/or misrepresentation of facts material to the issuance of this Service Contract. This Service Contract is transferable to a new owner for a $25 fee. For the month-to-month payment option, coverage begins upon receipt of the initial electronic payment and continues provided monthly electronic payments are received. A 7-day grace period is allowed for failed electronic payments. Coverage terminates at the end of that period. Terminated coverage may be reinstated for the remaining contract term, subject to the terms and conditions then in effect for new contracts, and begins 14 days after payment is received.

When coverage begins

Coverage begins 14 days after occupying the home. The 14-day waiting period is waived if a home inspection completed less than 90 days earlier by a certified inspector is provided and shows the item was in good working order and did not need service or maintenance. Items identified on the seller disclosure or buyer inspection as not working properly are excluded unless repair receipts from a licensed contractor show the item was fixed. Covered systems or items that break or stop working during the coverage period are subject to these terms. Items that fail on the first attempt of use are not covered unless this agreement states otherwise. The homeowner is responsible for routine maintenance, including cleaning, changing filters, and manufacturer-specified maintenance.

Heating or plumbing emergencies

For a heating or plumbing emergency, the Company will dispatch within 24 hours. With preapproval, the Company will pay up to $90 per night for a maximum of three nights of hotel accommodations. A receipt is required for reimbursement. Customer Service will make every effort to expedite emergency service.

Non-emergency service

Non-emergency dispatches will be scheduled for the first available business day and time. In some circumstances, it may take more than 48 hours for a Service Provider to contact the homeowner. Additional charges payable by the homeowner may apply if service is requested outside normal business hours.

Repair or replacement

The Company has sole discretion to repair or replace a service-call item.

Homeowner's insurance

The Company will not cover items covered by a homeowner's insurance policy. Documentation from the insurer may be requested.

Contract liability limit

Each contract is limited to an aggregate liability of $20,000.

Limited service contract

This is a limited Service Contract and may not cover every system or item in the home. It provides protection, at a reasonable cost, against breakdown from normal wear and tear for specifically covered items, but may not cover the entire repair or replacement cost. Systems or items not listed as covered are not covered. In homes with multiple furnaces, water heaters, air-conditioning units, heat pumps, garage door openers, or similar equipment, only one unit per coverage item is covered unless additional coverage is purchased. Heating, air conditioning, water heaters, and heat pumps have age restrictions unless Premium Warranty is purchased.

Item-specific liability limits

Some covered items have limited payouts. The maximum payout for repair or replacement is the aggregate amount of all repairs for that item during the contract term, including the free second year of coverage when applicable. See the individual coverage details for each limit.

Eligible property and location

Coverage applies only to parts of mechanical systems located in a single-family residence or condominium unit. Manufactured or modular homes, mobile homes, and trailers are excluded. Covered items must be within the main perimeter of the home's main foundation unless this agreement states otherwise. Items or systems in rooms or buildings used for commercial or business purposes are not covered. The property must be owner occupied.

Mechanical failure exclusions

This Service Contract is intended only for mechanical or component failures. It does not cover failures caused directly or indirectly by mold, mildew, mycotoxins, fungus, bacteria, virus, condensation, wet or dry rot, known or unknown pre-existing conditions, or any other contributing cause or event. It does not cover malfunction caused by insufficient or excessive capacity; cosmetic defects; flues; venting; chimneys; exhaust lines; replaceable filters; light bulbs; fire-sprinkler, radon, or other leak-detection systems; solar systems or components; home-management automation systems; windows; skylights; or remote controls. It does not cover repair, replacement, installation, or modification of an item determined defective by the Consumer Product Safety Commission or another regulatory body when a distributor or manufacturer has issued a recall, warning, or defect determination. Items covered by an existing manufacturer, distributor, or contractor warranty are also excluded.

Damage, casualty, and hazardous materials

The Company is not responsible for repairs or replacements required because of improper installation, missing parts, fire, explosion or other casualty, war, terrorism, flood, smoke, water damage, lightning, freezing, earthquake, theft, storms, accidents, vandalism, acts of God, accidental damage, pest or animal damage, negligence, or misuse, whether or not insured by the homeowner. The Company is not responsible for remediation involving toxic, hazardous, inflammable, reactive, or corrosive materials, asbestos, lead-based paint, or mold.

Access, construction, and restoration

The Company is not responsible for securing or providing access to covered items; construction, carpentry, or other modifications needed to relocate, remove, or install a covered item or part; restoring floor coverings, cabinets, countertops, paint, tile, walls, or similar finishes; or cranes and other specialty vehicles or equipment needed to install, remove, or access an item.

Capacity, codes, and permits

The Company will not upgrade equipment or make improvements because of insufficient capacity or failure to meet city, state, federal, or utility regulations, codes, or legally required upgrades, including permits.

Standard replacements and service delays

Replacements will use standard makes and models. Appliance color is not guaranteed. The Company is not responsible for failure to provide reasonable service because of conditions beyond its control, including delays in obtaining equipment, parts, or labor.

Binding arbitration

Any dispute arising under this agreement shall be submitted for binding arbitration through the local office of the American Arbitration Association. Each party shall pay for its own representative and share arbitration costs equally. The arbitrator's award is final and binding and may be enforced by a court of law.

Free limited second-year coverage

To qualify for the free limited second year of coverage for heating, roof, electrical, and plumbing systems, the Company must receive a buyer's inspection completed by a certified inspector. Each system must qualify independently. Purchasing Premium Warranty does not determine this coverage; qualification is based solely on the inspection results and actual age of the item. One or all systems may be excluded from second-year coverage.

  • Central heating system: The unit must be 10 years old or less based on the manufacturer's date stamped on the furnace, operable with no major problems, and rated satisfactory or better.
  • Roof covering: The roof may have no more than two layers, must be 10 years old or less, and must have working ventilation and roof covering. The inspector may need to estimate its age.
  • Electrical system: The system must be operable with no code violations or major issues and must have circuit breakers, not fuses.
  • Plumbing system: The system cannot contain galvanized plumbing and must be in good working order with no leaks or evidence of leaks.

Seller Coverage registration

Seller Coverage is provided at no charge while the home is actively listed for sale. By registering Seller Coverage, the seller agrees that, if the home sells, a Goldshield buyer home warranty will be purchased for the buyer at closing. Seller Coverage registration does not require the seller to select a Standard or Premium buyer plan or make a payment when Seller Coverage is registered.

Coverage recipient acknowledgment

The person receiving coverage under this Service Contract (the Covered Party), whether a buyer or seller, agrees to and authorizes the broker and/or home inspector to release the Seller's Disclosure Statement, purchase agreement, and any inspection reports needed to validate coverage information.

The Covered Party attests that the property will be owner occupied, acknowledges that this is a limited Service Contract, and confirms that they have reviewed the covered items and these Terms of Coverage.

The Covered Party represents that all items submitted for coverage are in good working condition. Any item that is not in good working condition or is defective when coverage begins must be identified and will not be covered. Coverage begins on the effective date shown in the agreement and continues for the stated term. Claims will not be accepted after that term ends.

Gold Shield Services, LLC, doing business as Goldshield Home Warranty, is a DBA of Macomb Holding Company and has a business relationship with Real Living Kee Realty, Premier Title Agency, LLC, Premier Casualty Insurance, LLC, Berkshire Hathaway HomeServices Kee Realty, JW Inspections East, and Mortgage 1, Inc.
